All 11 Planned Parenthood providers with abortion care stopped scheduling abortion-related visits before six weeks of pregnancy.

The 11 Planned Parenthood clinics in Texas that provide abortions have stopped visiting for the procedure if it is performed after six weeks of pregnancy, a spokeswoman for the organization told The 19th.

The measure, which took effect in mid-August, takes effect Wednesday in response to Texas’ new abortion law. The law, known as Senate Bill 8, would ban the procedure after six weeks of pregnancy and give private citizens the right to sue anyone they believe assisted in an abortion after that period.

“This law has been wreaking havoc for weeks,” said Ianthe Metzger, director of state media for Planned Parenthood.

Another major abortion provider in Texas, Whole Woman’s Health, is seeing as many patients as possible until Wednesday, said Amy Hagstrom Miller, the clinic’s CEO. Starting Wednesday, they will only schedule abortions for people who are seven weeks pregnant or less.

“If they’re working really hard, they can get involved. College students get all-nighters. I imagine judges can, too,” said Melissa Murray, a law professor at New York University and an expert on reproductive policy.

Time is of the essence, he added. If the law goes into effect, even temporarily, it could destroy the abortion landscape in Texas.

“Once this goes into effect, even if the law is later found to be unconstitutional, the clinics will be closed,” Murray said.

The Supreme Court, which has a 6-3 conservative majority, plans to take up abortion rights this fall in a case testing the constitutionality of Mississippi’s 15-week abortion ban. But it’s unclear how the case or any subsequent rulings will affect Texas law, legal experts said.

For now, the Texas law — the strictest pro-abortion law in the country — effectively bans abortion for many Texans. Many people do not even know that they are six weeks pregnant. In 2018, the most recent year for which federal data is available, nearly two-thirds of abortions nationwide occurred after six weeks.

If the law goes into effect, Texans will ostensibly be able to travel to other states to get an abortion. In April 2020, the governors of Texas and Oklahoma temporarily banned abortions, citing the COVID-19 emergency. After it went into effect, Planned Parenthood of the Rocky Mountains reported a 12-fold increase in the number of patients seeking abortions, Metzger said.

The University of Texas at Austin Policy Assessment Project estimates that if the law goes into effect, 8 in 10 Texans seeking an abortion will not be able to obtain one in the state. Forty-six percent of Texans seeking an abortion can force the pregnancy to continue.

She said the organization is working with the National Abortion Foundation to raise funds for out-of-state abortion patients. But he expects many patients to fall through the cracks — especially those who can’t take time off work or can’t afford long-distance travel or childcare.

And it’s unclear whether such a case, or telling people where else to go for abortions, could put providers at risk of civil lawsuits under the Texas ban.

“It’s all weird and amorphous, but I think the point is: to create confusion so that people think twice before offering help,” Murray said. “It isolates the pregnant person and leaves her without a real network.”

Planned Parenthood announced in an announcement that it was opening a new facility 15 miles from the Missouri border because of Missouri’s abortion restrictions.

“Make no mistake – this new mega facility is not a response to growing demand, nor is it a sign of concern for women,” Knorr said. “This facility was created to fill a void that they saw.”

Earlier this year, Missouri officials refused to renew the license of the state’s last abortion provider. Planned Parenthood fought the measure and was granted a stay, but the clinic’s future remains uncertain.
